Indian tele-companies are reportedly planning to challenge the government's move to restrict the sale of airwaves. As per a latest update, mobile phone companies are planning to drag the government to court over recent policy decisions related to the upcoming spectrum auctions. This will probably delay the sale process, which will ultimately add to the uncertainty prevailing in the litigation prone sector.
It is reportedly said that the industry body represents the GSM tele-companies including Bharti Airtel, Vodafone, Idea and Aircel, among others.
According to Rajan Mathews, Director-General of the Cellular Operators Association of India (COAI), these telecom operators are carefully examining their legal options regarding as many as five key policy decisions linked to the airwaves sale. These policies include the discrimination in terms of payment for airwaves secured in the auctions along with the spectrum usage charge between GSM and CDMA companies.
It is quite possible that Idea Cellular will approach court separately over the government's decision to limit the spectrum sale to a maximum of 13.75 MHz in every region, insiders report informed.
As a matter of concern, it is found; the Supreme Court had quashed licenses of nine operators early back in February and directed the government to issue fresh permits through an auction.
